When the Energy Efficiency Act (EnEfG ) came into force on 18 November 2023, the requirements of the Energy Services Act (EDL-G) for companies were extended. Among other things, the obligation to set up energy management systems (EMS) or environmental management systems (EMS) was introduced for companies. Regardless of SME status, it applies to companies that have an average total energy consumption of more than 7.5 gigawatt hours (GWh)per year in the last three calendar years.
Regardless of whether they are SMEs or non-SMEs, all companies with a total annual energy consumption of more than 7.5 GWh are obliged to set up and operate an energy management system (EMS) in accordance with DIN EN ISO 50001 or an environmental management system (EMS) in accordance with EMAS.
By 18 July 2025, companies that have achieved the status of a company in accordance with Section 8 (1) EnEfG (average total final energy consumption > 7.5 GWh/a) by the end of 17 November 2023 must have set up an EMS or EMS.
The statutory obligations under the EnEfG are checked as part of a random check via electronic communication channels.
The BAFA sampling procedure may require the company to submit the documents prepared as part of the management systems operated (EMS in accordance with DIN EN ISO 50001 or EMS in accordance with EMAS).
Obligated companies must set up an EMS or EMS within 20 months of exceeding the total energy consumption limit of 7.5 GWh/a for the first time. The successful installation concludes with ISO 50001 certification or entry in the EMAS register.
If a company fails to comply with this regulation, a fine may be imposed. The provisions on fines apply to companies subject to obligations under Sections 8 and 9 of the EnEfG. The amount of the fine can be up to 100,000 euros.
